Terms & Conditions of Business

Introduction

These Terms & Conditions apply to all quotations, orders and contracts entered into with Door Drops 4 U ("the Company"). By placing an order with Door Drops 4 U, the Customer agrees to these Terms & Conditions.

Definitions

Company means Door Drops 4 U.


Customer means the individual or organisation placing an order.


Goods means all printed materials supplied by the Company.


Services means design, artwork, printing, storage, fulfilment, mailing, leaflet distribution and any associated services.

Quotations

All quotations are valid for 30 days unless otherwise stated.


Quotations are based on information supplied by the Customer. Any changes to specification may result in revised pricing.


The Company reserves the right to amend quotations where production costs, material prices or delivery charges change beyond its reasonable control.

Orders

An order is deemed accepted once the Customer provides written approval by email, purchase order or other written confirmation.


Once accepted, the order becomes legally binding.

Artwork & Proof Approval

The Customer is responsible for ensuring all artwork, copy, spelling, grammar, contact details and images are correct before approval.


Where proofs are supplied, production will not commence until written approval has been received.


The Company accepts no responsibility for errors contained within artwork approved by the Customer.

Printing

Every effort is made to reproduce colours accurately; however, exact colour matching cannot be guaranteed.


Variations in colour, density and finish are considered acceptable within normal commercial printing tolerances.


The Company reserves the right to over or under supply by up to 5%, invoicing only for the quantity supplied unless otherwise agreed.


Paper stocks may occasionally be substituted with equivalent products due to manufacturer availability.

Leaflet Distribution

Distribution dates are estimates and are not guaranteed.


Delivery schedules may be affected by:

  • Weather

  • Traffic conditions

  • Access restrictions

  • Force Majeure events

  • Public holidays

  • Third-party carrier delays


Where Door Drops 4 U uses Royal Mail or other third-party distribution providers, their operating standards and delivery schedules apply.


Leaflet distribution is carried out using industry best practice, however Door Drops 4 U cannot guarantee delivery to every individual property due to:

​

  • Gated developments

  • Security restrictions

  • Properties displaying "No Junk Mail" signage

  • Vacant properties

  • Unsafe access


Distribution maps, GPS tracking or completion reports may be supplied where applicable but do not constitute a guarantee that every individual property has received a leaflet.

Customer Supplied Materials

Where Customers supply artwork, print files or printed materials, these remain entirely at the Customer's risk.


The Company accepts no liability for:

 

  • Incorrect quantities supplied

  • Poor print quality

  • Damaged materials received

  • Incorrect artwork supplied

Delivery

Delivery dates are estimates only.


The Company shall not be liable for any loss arising from delayed delivery.


Risk transfers to the Customer upon delivery to the nominated address or collection by the Customer.

Storage

Where goods are stored by the Company on behalf of the Customer:
Storage charges may apply.


Goods remaining in storage beyond the agreed collection period may incur additional charges.


Goods left uncollected for more than 12 months may be disposed of after written notice.

Payment

Unless otherwise agreed in writing:


New customers: Payment in full before production.


Account customers: Payment within 30 days from invoice date.


Late payments may incur:

 

  • Statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

  • Recovery costs.

  • Suspension of future work.

Cancellation

Orders cancelled after production has commenced will incur charges reflecting work completed.


Where printing has begun, the Customer shall be liable for the full contract value.


Distribution bookings cancelled after confirmation may incur cancellation charges from third-party providers.

Customer Content

The Customer warrants that all supplied content:

 

  • Does not infringe copyright.

  • Does not breach trademarks.

  • Is lawful.

  • Does not contain defamatory material.

  • Complies with UK advertising legislation.


The Customer agrees to indemnify Door Drops 4 U against any claims arising from supplied content.

Confidentiality

Both parties agree to treat confidential information as confidential and not disclose it to third parties except where required by law.

Data Protection

Door Drops 4 U processes personal data in accordance with the UK GDPR and Data Protection Act 2018.


Where mailing lists are supplied by Customers, the Customer confirms they have the lawful authority to use such data.

Force Majeure

The Company shall not be liable for failure or delay caused by circumstances beyond its reasonable control including but not limited to:

​

  • Flood

  • Fire

  • Pandemic

  • Industrial action

  • Fuel shortages

  • Government restrictions

  • Failure of suppliers

  • Transport disruption

Limitation of Liability

The Company's total liability shall not exceed the value of the order.


The Company shall not be liable for:

 

  • Loss of profit

  • Loss of business

  • Indirect losses

  • Consequential losses

  • Missed marketing opportunities

Claims

Claims relating to shortages or damage must be made within 48 hours of delivery.


Claims relating to print quality must be made within seven days.


No claim will be considered once goods have been used or distributed.

Intellectual Property

All artwork, designs, templates and creative work remain the intellectual property of Door Drops 4 U unless otherwise agreed in writing.

Retention of Title

Ownership of goods remains with Door Drops 4 U until payment has been received in full.

Governing Law

These Terms & Conditions shall be governed by the laws of England and Wales.


Any disputes shall be subject to the exclusive jurisdiction of the English courts.
